29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) and (c) of this section: a) Employees were not protected from the hazard of cave-ins by shoring, sloping or other protective means while working in a trench having a depth of approximately 6 feet. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) Employees were not provided with a safe means of egress when required to work in a trench having a depth of approximately 6 feet. No abatement certification or documentation required for this violation. C & J Backhoe Service, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651 (c)(2) which was contained in OSHA inspection number 311369870, citation 1, item 1, issued on January 9, 2008 and became final order on or about November 30, 2008.
