29 CFR 1910.1200(e)(1): The employer had not developed and implemented a written hazard communication program to include the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (a) Sopris West, 4185 Salazar Way, Frederick, CO: On and before January 25, 2012, the employer did not develop, implement, and maintain a written hazard communication program. The employer did maintain a material safety data sheet (MSDS) binder in the workplace, but that binder did not contain a written hazard communication program, a list of chemicals used in the workplace, or the method the employer will use to train employees. Abatement Note: The employer shall ensure a written Hazardous Communication Program is equipped with the following elements: 1) A list of the hazardous chemicals known to be present in the workplace; 2) Labels and/or other forms of warning secured to containers into which hazardous chemicals were transferred; 3) Material safety data sheets for each hazardous chemical utilized in the workplace; and 4) Provide employees with effective information and training on hazardous chemicals in their work area on initial assignment and whenever a new physical or health hazards is about to be introduced. Abatement Note: Abatement certification is required for this item (See enclosed Abatement-Certification Letter).

29 CFR 1910.1200(e)(1)(i): The employer did not maintain a list of hazardous chemicals known to be present using an identity that was referenced on the appropriate material safety data sheet: a)Sopris West, 4185 Salazar Way, Frederick, CO: On and before 12/5/11, the employer did not maintain a list of the hazardous chemicals and/or products used throughout the facility. Chemicals include but are not limited to solvents, lubricants, and fluids commonly used during maintenance of machinery and equipment. The employer did maintain a material safety data sheet binder in the detail shop, but that binder did not contain a list of hazardous chemicals that were known to be present in the workplace.
