29 CFR 1926.20(b)(2):     Such programs shall provide for frequent and regular inspections of the job sites, materials, andequipment to be made by competent persons designated by the employers.    a- Building 100, Kestrel Court, West Windsor NJ: A competent person did not conduct frequent and regular inspections of the jobsite.  A company employee was exposed to hazards including, but not limited to fall hazards when installing flanges while working from a pitched roof without the use of fall protection.  Condition observed on or about  1/31/12.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19

29 CFR 1926.503(a)(2):     The employer shall assure that each employee has been trained, as necessary, by a competent personqualified in the following areas:    a- Building 100, Kestrel Court, West Windsor NJ -  A company employee was exposed to fall hazards at the worksite when they had not received fall protection training from a competent person.  Condition noted on or about 01/31/12.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502.Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fallprotection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complieswith 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a- Building 100, Kestrel Court, West Windsor NJ -  A company employee was exposed to fall hazards, in excess of 25 feet to the ground surface below, when installing a flange onto a vent pipe and performing other related work from a pitched roof.  The exposed company employee was not provided with/utilizing a Personal Fall Arrest System, safety net, guardrails, etc. at the time of the inspection.  Condition observed on or about 01/31/12..
