29 CFR 1926.453(b)(2)(iv): Employee(s) were not standing firmly on the floor of the basket, were sitting or climbing on the edge of the basket, or were using planks, ladders, or other devices for a work position: a) 12 Monroe Avenue, Spring Lake, NJ: The employees did not remain firmly in the basket while preforming work from the Grandall Aerial Lift. The employee exited the basket and stood on top of the chimney to chalk the top. The height was estimated as 28 feet high from the ground level, observed on or about 2/8/12. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift. 12 Monroe Avenue, Spring Lake, NJ: Employee was working from the basket of a Grandall Aerial Lift without being attached to the basket. The employee was working outside of the basket in order to caulk the chimney, observed on or about 2/8/12. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
