Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible whey dust deflagration, explosion, or other fire hazards while working at or near spray dryers and an associated media-type dust collector (bag house) which lacked a means of fire protection and while working at or near spray dryers and an associated media-type dust collector (bag house) which had deflagration relief panel discharges within indoor locations:  a) At the whey plant floors one through three:  The spray dryers (protein, permeate) and the gravity dryer (lactose) producing combustible whey dust and an associated media-type dust collector (bag house) handling combustible whey dust all lacked a means of fire protection.  b) At the whey plant floors one through three: The spray dryers (protein, permeate) and the gravity dryer (lactose) producing combustible whey dust and an associated media-type dust collector (bag house) handling combustible whey dust all contained multiple deflagration relief panels with discharges within indoor locations.
