29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job sites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):        Paragon Restoration, LLC did not perform frequent and regular inspections by a competent person of the job site located at 11607 Old St. Charles Road, Bridgeton, MO, 63044.  Workers were permitted to work while exposed to an approximate 11'11" fall hazard as they were on the roof performing work activities without the use of any fall protection systems on or about February 3, 2012.

29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    Three employees were observed performing masonry application to the chimney while standing on the 4:12 pitch roof of the residential structure without the use of any fall protection system.  The eave to ground distance was approximately 11'11" at the west side of the structure and approximately 11' at the front of the residential structure located at 11607 Old St. Charles Road, Bridgeton, MO, 63044.    Paragon Restoration LLC was initially cited for a violation of this Occupational Safety and Health Standard or its equivalent standard, 1926.501(b)(13), which was contained in the OSHA inspection 315653444, Citation 1, Item 1, Issued 10/14/11, and affirmed as a final order on 09/28/11, with respect to a workplace at 12084 Colonial Drive, Maryland Heights, MO, 63044.
