29 CFR 1926.150(c)(1)(vi): A fire extinguisher, rated not less than 10B, was not provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas were being used on the jobsite: (a)(LOCATION, IDENTIFICATION OF FLAMMABLE OR COMBUSTIBLE LIQUIDS OR GASES, CONDITIONS OF USE, AND HAZARDS) NOTE: THIS STANDARD DOES NOT PERTAIN TO FUEL TANKS OF MOTOR VEHICLES. On or about 02/01/12, on Maple Ridge Road, in Medina, NY., at the Tractor Supply retail store under demolition and rehabilitation, workers were performing general construction activities including painting, framing and electrical work without the availability of portable flire extinguishers, when flammable materials (Sherwin Williams - Dry Fall) and ignition sources present such as "Sure Flame" heating unit.
