29 CFR 1926.451(b)(1)(i):     Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.    a) On or about 02/14/12, on the 2nd floor of construction site, 189 N. Pearl St.,Buffalo, NY:  Employee installing a 2x4 on the ceiling while working from the top level of a mobile fabricated frame scaffold was exposed to a fall of approx. 11 ft. because the level was not fully planked. The width of the scaffold was 60 inches, and there were only two 19 in. wide "piks" in place instead of the three required.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.     a) On or about 02/14/12, on the 2nd floor of construction site, 189 N. Pearl St.,Buffalo, NY:   Employee was exposed to a potential fall of up to 11 ft. while accessing the second level of a mobile fabricated frame scaffold by climbing the end frame of the scaffold. No ladder was provided.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.452(w)(2):     Scaffold casters and wheels were not locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold was used in a stationary manner:    a) On or about 02/14/12, on the 2nd floor of construction site, 189 N. Pearl St.,Buffalo, NY:  Employee was exposed to potential fall of approx. 11 ft. while performing work from the 2nd level platform of a mobile fabricated frame scaffold. Only one of the four wheels on the scaffold was locked.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.454(a)(5):    The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include any other pertinent requirements of this subpart:    a) On or about 02/14/12, on the 2nd floor of construction site, 189 N. Pearl St.,Buffalo, NY: Employee performing work from the 2nd level platform of a mobile fabricated frame scaffold was not trained on how to recognize the hazards associated with scaffolds and the OSHA regulations pertaining to working from scaffolds.    ABATEMENT CERTIFICATION REQUIRED
