29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Building Restoration Specialties, Inc. @ 112 N. College Ave., Fort Collins, CO 80524: On and before February 1st, 2012, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. An employee on-site was permitted to work in an area where fall hazards existed. The contractor did not conduct frequent and regular safety inspections to identify hazards on the job-site. The condition exposed an employee to a fall hazard of approximately 30 feet from the roof of the Avery Building.

1926.501(b)(1) 29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system. (a)Building Restoration Specialties, Inc. @ 112 N. College Ave., Fort Collins, CO 80524: On and before February 1st, 2011, the exposing employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system in that an employee was engaged in masonry restoration work on the roof without a fall protection system. This condition exposed the subcontractor employee to a fall hazard of approximately 30 feet.
