29 CFR 1926.453(b)(2)(v): A body belt (or harness) was not worn with a lanyard attached to the boom or basket when an employee was working from an aerial lift: a) An employee was not wearing a fall protection harness; was not tied off in the aerial lift. Employees were using aerial lifts to attach insulation and metal sheeting to the exterior of the building. Elevation; to 65 ft. Location: 338 3rd Ave, Brooklyn, N.Y. On or about 01/31/2012 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: a) The employer did not provide effective scaffold (aerial lift) safety training; employer did not ensure all employees will wear harnesses and tie off when working in aerial lifts. The employer was using two aerial lifts to install insulation and metal corrugated sheeting to the exterior of the building. Elevation; to 65 ft. Location: 338 3rd Ave, Brooklyn, N.Y.
