LOCATION: 150 Greenwich Street, New York, NY On or about 2/16/2012 Employer did not conduct shift inspections of control and drive mechanisms for contamination by water or other foreign matter. Water was found in the hydraulic fluid for the motors. There were several loads hoisted by the crane which were in excess of 100% of the rated capacity during the crane's operation. 29 CFR 1926.1417(o)(3)(ii): The operator must begin hoisting the load to determine, using a load weighing device, load moment indicator, rated capacity indicator, or rated capacity limiter, if it exceeds 75 percent of the maximum rated capacity at the longest radius that will be used during the lift operation. If it does, the operator must not proceed with the lift until he/she verifies the weight of the load in accordance with paragraph (o)(3)(i) of this section. LOCATION: 150 Greenwich St, New York , NY On or about 2/16/12 Employer lifted loads in excess of 75% of the cranes rated capacity and the operator did not verify the wieght of the load. 29 CFR 1926.1417(s): The operator must test the brakes each time a load that is 90% or more of the maximum line pull is handled by lifting the load a few inches and applying the brakes. In duty cycle and repetitive lifts where each lift is 90% or more of the maximum line pull, this requirement applies to the first lift but not to successive lifts. LOCATION: 150 Greenwich St, New York , NY On or about 2/16/12 The lifts of the loads in excess of 90% were completed and the brakes were not tested. From review of the operation of the loads being lifted there was no stoppage to test the brakes as the load was being lifted. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENATLY OF $1000 AS PER 29 CFR 1903.19
