29 CFR 1910.1200(e)(1):  The employer had not developed, implemented, or maintained a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section will be met:    On or about February 15, 2012, the employer had not compiled and made available to the workers a written hazard communication program for such hazardous materials/chemicals as, but not limited to the gasoline and kerosene dispensed on site.

29 CFR 1910.1200(g)  The employer did not have a material safety data sheet in the workplace as required for each hazardous chemical they use:    On or about February 15, 2012, the employer had not compiled and made available to the workers the required material safety data sheets (MSDS) as required for such hazardous materials/chemicals as, but not limited to the gasoline and kerosene dispensed on site.

29 CFR 1910.1200(h):  Employees were not provided information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area:    On or about February 15, 2012, the employer had not provided training for such hazardous materials/chemicals as, but not limited to the gasoline and kerosene dispensed on site.      Elements of a Hazard Communication information and training program are:    Information to employees shall include:    1)  Any operations in their work area where hazardous chemicals are present.    2)  The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and material safety data sheets.    Training for employees shall include:    3)  Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.)    4)  The physical and health hazards of the chemicals in the work area,    5)  The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to  be used.    6)  The details of  the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information.
