OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from a moving vehicle: a) On or about February 16, 2012 and at times prior, employees were exposed to injury while placing traffic cones along US Highway 24 where employees were not protected from falling off of a platform on the rear of a moving truck. Abatement Note: Several feasible and acceptable methods of abatement would be to install a standard rail system around the platform on the rear of the truck or use a restraint system to restrain employees in the truck. Another method would be to use an automatic cone placement and retreival system.
