29 CFR 1926.501(b)(13): 29 CFR 1926.501 (b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) 231 Main Street, Lakewood, NJ: An employee was not utilizing fall protection when working from heights greater than 6 feet from the ground level. The employee was working at a height from the ground level of greater then 25 feet to the ridge on a low sloped roof without the use of fall protection, observed on or about 2/17/12.

29 CFR 1926.20(b)(2): 29 CFR 1926.20 (b)(2) The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer. a) 231 Main Street, Lakewood, NJ: An Employee was not utilizing fall protection when working from heights greater than 6 feet from the ground level. The employee was working at a height from the ground level of approximately 25 feet to the ridge on a low slope roof of a new commerical structure, observed on or about 2/17/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
