OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees    Cargo hatch starboard side second deck:  On or about February 12, 2012 and times prior thereto, the CM 622 1 ton chain hoist used to lift the hatch had a sprung hook, no latch and was not rated for the capacity of the hatch.  This condition exposed employees to struck-by hazards.    Cargo hatch port side second deck:  On or about February 12, 2012 and times prior thereto, the CM 622 chain hoist used to lift the hatch had no latch on the hook.  This condition exposed employees to struck-by hazards.

29 CFR 1915.56(b)(4):     Cables in poor repair shall not be used. When a cable other than the cable lead referred to inparagraph (b)(2) of this section becomes worn to the extent of exposing bare conductors, the portion thus exposed shall be protected by means of rubber and friction tapes or other equivalent insulation.    Processing deck:  On or about February 12, 2012 and times prior thereto, welding cable available for use had two cuts to the conductor.   This exposed employees to possible shock hazards from coming in contact with the conductor while welding with the cable.
