29 CFR 1910.23(e)(1):     Standard railing(s) did not consist of top rail, intermediate rail and/or posts and/or did not have a vertical height of 42 inches (106.7 cm) nominal from upper surface of top rail to floor, platform runway, or ramp level.  The intermediate rail was not approximately halfway between the top rail and the floor, platform, runway, or ramp:    Employees working on the top of the bin decks were exposed to fall hazards because the guardrail system was not constructed to provide adequate protection. There were areas in which the midrail was missing.

29 CFR 1910.272(g)(1)(ii):     Prior to entry, all mechanical. Electrical, hydraulic, and pneumatic equipment which presented a danger to employees inside bins, silos, or tanks in the grain handling facility were not disconnected, locked out and tagged, blocked off, or prevented from operating by other means or methods:     Employees were exposed to amputation hazards while entering a grain bin, which contained corn, because mechanical and electrical equipment was not disconnected and/or deenergized prior to entering the grain bin.
