29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about February 7, 2012, and at times prior to that date, for the employees working in an approximately 7 1/2 foot deep trench and exposed to a potential cave-in hazard at the intersection of South Dakota Avenue and West Tenth Street, Sioux Falls, South Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 314475120, Citation Number 1, Item Number 5, and was affirmed as a final order on 09/01/10, with respect to a workplace located at Jefferson Avenue and Tenth Street, Sioux Falls, SD.
