29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: (a) There was no program on energy control procedures, employee training, and periodic inspections, to include providing locks and training to employees wiping down the tables, as well as changing and adjusting the tooling, on the CNC mills and CNC lathes, such as the Daineche CNC Lathe, the Hurco CNC Mill (S/N B42S-0100-2030Eb), the Hurco CNC Mill (S/N B42S-0100-9030EB), and the Proto-trac CNC Lathe, as well as changing the saw blade on the DoAll Horizontal Band Saw. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.: (a) On February 27, 2012, Hurco CNC Mill (S/N B42S-0100-2030EB) was run with the guards removed. (b) On February 27, 2012, the Daineche CNC Lathe was run with the doors open and the guards were not interlocked with the machine control system. (c) The guards on the Hurco CNC Mill (S/N B42S-0100-9030EB) were not interlocked with the machine control system. (d) The chucks on the LeBlond Machine Lathe were not guarded. (e) The blade on the Wells Horizontal Band Saw had eight inches of unguarded blade. 29 CFR 1910.215(a)(4): Work rests. On offhand grinding machines, work rests shall be used to support the work. They shall be of rigid construction and designed to be adjustable to compensate for wheel wear. Work rests shall be kept adjusted closely to the wheel with a maximum opening of one-eighth inch to prevent the work from being jammed between the wheel and the rest, which may cause wheel breakage. The work rest shall be securely clamped after each adjustment. The adjustment shall not be made with the wheel in motion: (a) The tool rests on the Baldo Pedestal Grinder were not adjusted to within 1/8th inch of the abrasive wheels, in that the abrasive wheel on the left side of the grinder had a gap of 1/2 inch between the abrasive wheel and the tool rest, and the abrasive wheel on the right had a gap of 1/2 inch between the tool rest and the abrasive wheel. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.215(b)(9): Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.): (a) The upper peripheral guard on the Baldo Pedestal Grinder was no adjusted within 1/4 inch of the abrasive wheel, in that the abrasive wheel on the left side of the grinder had a gap of two inches between the guard and the abrasive wheel, and the abrasive wheel on the right side of the grinder had a gap of 1-1/2 inches between the guard and the abrasive wheel. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.305(g)(2)(iii): Flexible cords and cables shall be connected to devices and fittings so that strain relief is provided that will prevent pull from being directly transmitted to joints or terminal screws: (a) There was one inch of outer insulation pulled away from the 110 volt AC flexible power cord, where it ran into the plug, and connecting the Baldo Pedestal Grinder to the power outlet, thereby exposing the inner insulated wires to damage and employees to an electrical hazard. 29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle.
