29 CFR 1926.20(b)(4): The employer failed to permit only those employees qualified by training or experience to operate equipment and machinery:  On or about February 23, 2012, and at times prior thereto, employees were operating two JLG 1930ES scissor lifts to install and erect light-gauge, steel roof trusses without receiving training from the employer to safely operate the lifts, exposing employees to the hazard of being struck by equipment and/or loads.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employer will permit only those employees qualified by training or experience to operate equipment and machinery.

29 CFR 1926.451(a)(6): Scaffolds were not loaded in accordance with the design by a qualified person:  On or about February 23, 2012, employees were transferring a stack of 6, light-gauge, steel trusses that measured approximately 70 feet in length on top of the JLG scissor lifts where the load was not in accordance with the manufacturer's design, exposing the employees to a fall hazard of approximately 18 feet.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that scaffolds are loaded in accordance with the design by a qualified person.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  On or about February 23, 2012, employees were using a spreader bar attachment on the forks of a JCB telescopic handler, Model #508, VIN #SLP5CBKA7U1290281, to lift the unsecured, light-guage, steel roof trusses being erected onto the new Sealy Police Department building, exposing employees to the hazard of being struck by materials and/or loads.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that modifications or additions which affect the capacity or safe operation of the equipment are not made without the manufacturer's written approval.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks: Section 605, Loading- Handle only stable or safely arranged loads.  On or about February 23, 2012, employees were transferring a stack of 6 roof trusses that measured approximately 70 feet long from the tines of a JCB telescopic handler to the JLG scissor lifts. The load became unstable and struck one of the lifts, resulting in a scissor lift tipping over, exposing employees to a fall hazard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to sure that employees are handling only stable and safely arranged loads.

29 CFR 1926.752(e): A site-specific erection plan was not developed by a qualified person and be available at the work site.   On or about February 23, 2012, the employer did not develop a site-specific erection plan for the construction site where employees were laying light-gauge, steel trusses approximately 70 feet long on top of two elevated Sunbelt scissor lifts to move the trusses to the East end of the building, exposing employees to an 18 foot fall hazard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that when employer elects, due to conditions specific to the site, to develop alternate means and methods that provide employee protection in accordance with 1926.753(c)(5), 1926.757(a)(4) or 1926.757(e)(4), a site-specific erection plan be developed by a qualified person and be available at the work site.

Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all loads will be rigged by a qualified rigger.
