29 CFR 1926.451(g)(4)(vii):  Each toprail or equivalent member of a guardrail system was not capable of withstanding, without failure, a force applied in any downward or horizontal direction at any point along its top edge of at least 100 pounds for guardrail systems installed on single-point adjustable suspension scaffolds or two-point adjustable suspension scaffolds, and at least 200 pounds for guardrail systems installed on all other scaffolds:      a)  On or about February 22, 2012, and at times prior, employees were exposed to fall hazards of over 10 feet because the employer did not ensure that all top rails used by employees working from a fabricated frame scaffold were capable of withstanding a downward or horizontal force of at least 200 pounds.  The employer allowed some guardrails to be constructed of two rail pieces joined together by wire in the middle of their horizontal run between frame pieces.

29 CFR 1926.451(h)(2)(ii):  A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:    a)  On or about February 22, 2012, and at times prior, employees were exposed to struck by hazards while they worked under and passed below a scaffold which held buckets, tools and other materials used in the application of stucco.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:                     a)  On or about February 22, 2012, employees were exposed to fall hazards of approximately 16 feet while they walked on and worked from an entrance canopy structure without the use of adequate fall protection.

29 CFR 1926.454(c)(2):      Employees were not retrained when conditions affecting scaffold safety changed:    a)  On or about February 22, 2012, and at times prior, employees were exposed to falls of up to 16 feet while they climbed up parts of a scaffold frame and bracing to access a permanent canopy structure above the building entrance.  The employees did not use a ladder or other appropriate means to travel to the canopy which was 39 inches above the scaffold platform.        The Rock Inc. dba The Rock Stucco was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.451(e)(1) or its equivalent which was contained in OSHA inspection 313418543, Citation 1, Item 2, issued May 7, 2010, with respect to a workplace located at 800 N. Broadway, Denver, CO 80204.  This citation became final on May 28, 2010.    The Rock Inc. dba The Rock Stucco was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.451(e)(1) or its equivalent which was contained in OSHA inspection 310595905, Citation 1, Item 1, issued April 1, 2008, with respect to a workplace located at 7133 W. Virginia Avenue, Lakewood, CO 80215.  This citation became final on April 21, 2008.
