29 CFR 1915.74(a)(9):     The employer permitted employees to board or leave a vessel when the upper end of the means of access rested on or was flush with the top of bulwark and substantial steps properly secured and equipped with at least one substantial handrail approximately 33 inches in height was not provided between the top of the bulwark and the deck.    A)     On the NCR Quest, which was Moored at the port of Port Angeles, the access to the ship rested on the starbord bulwark and the steps from teh ganway to the deck of the ship did not have any handrails.

Referenced from 29 CFR 1915.154    29 CFR 1910.134(c)(2)(i):     Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:    A)     Employess working for the employer on the NCR Quest, were voluntarily wearing respirators, and the employer had not provided information covered in Appendix D of 29 CFR 1910.134 to them prior to them using the respirators during job duties.

29 CFR 1910.134(c)(2)(ii):     The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:    A)     On the NCR Quest, employees used half face air purifying respirators on a voluntary basis, and the employer did not make sure the employees were medically fit to wear the respirators.    B)     On the NCR Quest, employees used half face air purifying respirators on a voluntary basis, and the respirators were not kept in a clean and sanitary condition.    C)     On the NCR Quest, employees used half face air purifying respirators on a voluntary basis, and the respirators were not stored in a place that would protect them from damage, or contamination.
