29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95( c) through (n ) was not instituted when employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85dBA: a) Garpo Marine Svc, Inc/Staten Island NY- Yard Area: The Employer did not provide a continuing effective Hearing Conservation Program for employees exposed to noise above 85 dBA. Employees were exposed to continuous noise levels equivalent to 425.3% and 294.9% respectively of the allowable dose of 50%, or 85 dBA for an 8-hour TWA. The exposure measured is equivalent to an 8-hour TWA of 100dBA and 98dBA respectively, which is above the 8-hour TWA of 85dBA over 102 minutes. Zero exposure was assumed for all unsampled time periods. Observed on or about 02/27/2012.
