29 CFR 1910.178(q)(1): Power-operated industrial truck(s) not in safe operating condition was (were) not removed from service. a. On or about February 28, 2012, the Mitsubishi forklift was operated with a broken propane tank clamp and was not removed from service. b. On or about February 28, 2012, the Clark GCS25 forklift was operated without a functioning horn and was not removed from service. c. On or about February 28, 2012, the propane powered Clark GCS25 forklift was operated while emitting 2.3-2.5% carbon monoxide. This was in excess of the recommended level of 1%. Inhalation of carbon monoxide can result in headaches, nausea and chemical anoxia.

29 CFR 1910.333(b)(2)(i): The employer did not maintain a copy of the written procedures outlined in 29 CFR 1910.333(b)(2) and did not make it available for inspection by employees: a) During the period of December 28, 2011 through February 28, 2012, at the above located workplace employees were required to work with premises wiring, lighting, plant machinery and other equipment. The employer did not have in place and in writing a safety-related work practices program as required by 29 CFR 1910.333(b)(1).
