(a) At the front of the EN Japanese Restaurant on or about February 24, 2012, a mobile scaffold was erected without supervision and direction of a competent person qualified in scaffold erection. The mobile scaffold was used to perform painting operations.

29 CFR 1926.452(w)(2): Scaffold casters and wheels were not locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold was used in a stationary manner: (a) At the front of the EN Japanese Restaurant on or about February 24, 2012, two of the four casters were not locked to prevent movement on a mobile scaffold. The locking mechanism on two casters were missing. The mobile scaffold was used by an employee in order to access and paint the awning frame. The employee was exposed to a 6 feet, 2 inch onto the asphalt surface below.
