29 CFR 1926.1101(k)(3)(i): Before the employer permitted its own employees to perform work subject to this standard in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM), the employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material therein pursuant to 29 CFR 1926.1101(k)(1): a) On or about September 22, 2011, and at times prior, employees were exposed to asbestos fibers because the employer failed to determine the presence, location and quantity of asbestos material in the ceiling and water pipe that were repaired or replaced and did not provide employees with this information. Bulk samples afterwards collected showed up to 2.5 percent asbestos.

29 CFR 1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace: a) On or about September 22, 2011, and at times prior, U.S. Postal Service, as controlling employer, employees were not protected from from exposure to unknown quantities of airborne asbestos fibers while performing Class II asbestos work because the employer had failed to perform an initial exposure assessment at or before the commencement of abatement activities. Bulk samples collected afterwards showed up to 2.5 percent asbestos.
