29 CFR 1926.20(b)(2):     29 CFR 1926.20 (b)(2) The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.    a) 232 Ocean Avenue, Deal, NJ:  The employer did not initate a program that provided for frequent and regular inspections of the job site.  Employees were exposed to fall hazards and stuck by hazards, observed on or about 4/13/12.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.100(a):     Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a)  232 Ocean Avenue, Deal, NJ:  Employees were exposed to struck by hazards while working under other employees performing roofing activities, observed on or about 4/13/12.

29 CFR 1926.501(b)(13):     29 CFR 1926.501 (b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.    a)  232 Ocean Avenue, Deal, NJ:  Employees of M&M Contractors LLC were exposed to a fall hazard of greater than 6 feet from the ground at two diffent levels of the home.  The employees were working without fall protection such as but not limited to harnesses, lanyards, and/or guardrail systems. The employees were working at the first level which was greater than 12 feet from the ground level, and the second level was greater than 21 feet from the ground level, observed on or about 4/13/12.
