29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about February 28, 2012, during construction activities including but not limited to installing soffit from a low sloped roof, the employer did not ensure employees were protected from fall hazards approximately 18 feet by ensuring a fall protection system/device was being used.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided: On or about February 28, 2012, during construction activities including but not limited to installing soffit from a low sloped roof, the employer did not ensure employees were provided a safe access to the roof. Employees were required to access the roof by stepping down approximately 3 feet to the lower working surface.
