29 CFR 1926.95(a):     Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided:    Lodewyk R. Metscher, conducting work at 26800 Woodmont Drive, Suite 5  Suite 10, Perrysburg, OH: On or about February 28, 2012, the employer failed to ensure that employees were wearing appropriate eye protection such as, but not limited to, safety glasses while securing shingles to the roof with Bostitch pneumatic nail gun. Employees were exposed to the hazards of eye injury from flying objects.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    Lodewyk R. Metscher, conducting work at 26800 Woodmont Drive, Suite 5  Suite 10, Perrysburg, OH: On or about February 28, 2012, the employer did not ensure that employees were protected from fall hazards while performing roofing work on 5/12 and 4/12 pitch roof of the one story residential building. Employees were exposed to fall hazards of approximately 9 feet from the roof to the ground below.    No additional abatement information is needed for this item.

29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    Lodewyk R. Metscher, conducting work at 26800 Woodmont Drive, Suite 5  Suite 10, Perrysburg, OH: On or about February 28, 2012, the employer failed to ensure that employees had been trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, or alternative measures of fall protection hazards while performing roofing work on 5/12 and 4/12 pitch roof of the one story residential building. Employees did not use fall protection and were exposed to fall hazards of approximately 9 feet from the roof to the ground below.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.1053(b)(1):     Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    Lodewyk R. Metscher, conducting work at 26800 Woodmont Drive, Suite 5  Suite 10, Perrysburg, OH: On or about February 28, 2012, the employer did not ensure that extension ladders, used to access the roof of the one story residential building, were extended at least 3 feet above the roof edge. The employees were exposed to approximately a 9 foot fall hazard when using the ladders to access the working level in order to conduct roofing activities.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
