29 CFR 1910.180(h)(1)(i): Crane(s) were loaded beyond the rated load, except for test purposes as provided in paragraph (e) of this section: WORKSITE: The Grove 40-ton truck mounted hydraulic crane, Model TMS500E & Serial Number 225152, was over loaded beyond the rated load capacity while lifting the Trans Cube double walled container which was approximately 30,315 pounds total weight. It was estimated per the load chart that the maximum lifting load to be less than 29,500 pounds with the 20 feet long boom at a 60-degree boom setting.

29 CFR 1910.184(i)(5): Synthetic web slings not included in Tables N-184-20 through N-184-22 were not used in accordance with the manufacturer's recommendations. WORKSITE: The synthetic web slings, used to hoist Trans Cube double walled contained were not used in accordance with the manufacturers recommendation in that the weight of the container (30,315 lbs) far exceeded the rated capacities of the slings. On or about February 23, 2012, one the above slings failed and caused the conainer to fall/displace during the hoisting process. A portion of the driver's cab was crushed from the incident.
