OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of lacerations and contusions by being caught in or falling into a v-shaped conveyor belt whose emergency stop was not functioning properly. (a) Where the emergency stop did not function properly on the v-shaped conveyor belt on the AB bin floor operating at 750 feet/minute. Among other procedures, one feasible and acceptable abatement method to correct the hazard is for the employer to come into compliance with the American Society of Mechanical Engineers, Safety Standards for Conveyors and Related Equpment- ASME B20.1-2012 which states in Section 5.12 Operation, Paragraph (h) Routine inspections and corrective maintenance measures shall be conducted to ensure that all guards and safety features are retained and function properly.
