29 CFR 1926.501(b)(13):  Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b):    a)  Halo Roofing, LLC, 612 Milwaukee Street, Denver, CO:  The controlling employer in charge of the worksite had not ensured the use of appropriate fall protection while employees working for a subcontractor removed and installed new roofing shingles.  On or about March 5, 2012, employees working for a sub contractor were permitted to work on a 5/12 pitch roof without an appropriate fall protection system.  Condition exposed employees to a fall hazard of approximately 10 feet.    Note:  If the employer determines using these systems is infeasible or created a greater hazard, the employer must develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502.    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.20(b)(2): Halo Roofing, LLC., 612 Milwaukee Street, Denver, CO:    The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:     a)  Halo Roofing, LLC., 612 Milwaukee Street, Denver, CO:  The controlling employer in charge of the worksite had not ensured an individual with the competency to identify safety and health hazards capable of causing injury conducted frequent inspections of the worksite. On and prior to March 5th, 2012, employees working for a sub contractor were permitted to work on a 5/12 pitch roof without adequate fall protection. Condition exposed employees to a fall hazard of approximately 10 feet.     Abatement Note:  OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.    Abatement Note:  Abatement certification is required for this item (See enclosed Abatement-Certification Letter).
