29 CFR 1926.21(b)(2):   The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  On or about March 6, 2012, five employees were constructing a masonry wall on the job site without the employer providing training on the recognition and avoidance of hazards, exposing the employees to a hazard such as, but not limited to, being struck by a falling concrete block wall.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee performing work for the company receives training on the hazards they can be exposed to.

29 CFR 1926.454(a):   The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  On or about March 6, 2012, employees were performing masonry work from tubular welded scaffolding that was erected on the inside of the wall under construction up to approximately 13 feet high without the employees receiving scaffolding training from the employer, exposing the employees to a fall hazard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee required to work from scaffolding is trained on the hazards associated with it.

29 CFR 1926.701(b):   All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement:  On or about March 6, 2012, employees were working near the open ends of the tubular welded scaffolding up to approximately 13 feet high where protruding rebar that measured approximately 1 and 1/2 feet high was not covered, exposing the employees to an impalement hazard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all protruding rebar is covered with protective caps when workers are required to work in the area.

29 CFR 1926.706(a)(1):   A limited access zone was not established prior to the start of construction on a masonry wall:  On or about March 6, 2012, employees were working around the danger zone of a masonry wall that they had built and another wall that was under construction without the employer establishing a limited access zone, exposing the employees to the hazard of being crushed by a falling wall.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a limited access zone is designated prior to the erection of masonry walls.

Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each masonry wall over eight feet in height is adequately braced to prevent overturning.

29 CFR 1926.451(b)(1):   Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  On or about March 6, 2012, four employees were working on the tops of the first and second level platforms of the tubular welded scaffolding up to approximately 13 feet high without each platform being fully planked, exposing the employees to a fall hazard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that scaffolding platforms are fully planked where employees are working.  The Jr Stucco Company was previously cited for a violation of this Occupational Safety and  Standard or its equivalent standard 29 CFR 1926.451(b)(1), which was contained in Inspection  Number: 312920085, Citation Number: 01, Item: 01, issued on: December 17, 2009, and was affirmed as a Final Order on January 12, 2010, with respect to a workplace located at: 8210 Broadway, Pearland, TX 77581.

29 CFR 1926.451(g)(1)(vii):   For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  On or about March 6, 2012, two employees were working on the top of the second tier of the tubular welded scaffolding up to approximately 13 feet high without guard rails installed on the sides and open ends, exposing the employees to a fall hazard.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all open sides of a scaffold over 10 feet high have guard rails installed.  The Jr Stucco Company was previously cited for a violation of this Occupational Safety and  Standard or its equivalent standard 29 CFR 1926.451(g)(4)(iii), which was contained in Inspection  Number: 315195149, Citation Number: 01, Item: 02, issued on: April 29, 2011, and was affirmed as a Final Order on June 6, 2011, with respect to a workplace located at: 19099 I-45 South, Shenandoah, TX 77385.
