OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by a locomotive. On or about February 13, 2012, an employee was preparing to move railroad ties with the diesel electric locomotive, when the locomotive slipped into gear and began moving on its own, exposing employees to the hazard of being struck by and/or dragged by the locomotive. Among other methods of abatement feasable and useful to correct this hazard, one method of abatement would be to: 1) Maintain engine transmission and gearing in proper working order. 2) Keep all personnel clear of locomotive during operation and never use tools to operate gear switching unit.
