Terry Mette dba Mette Construction had an employee exposed to a 12 ft., 2 in. fall hazard without fall protection, while working from the roof on a residential construction site in Teutopolis, Illinois.   The employer did not have a competent person conducting frequent and periodic safety inspections at the construction site.

29 CFR 1926.451(e)(1):     When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used.      Terry Mette dba Mette Construction had an employee exposed to a 10 ft., 7 in. fall hazard while accessing a scaffold work platform by climbing the scaffold frame, and the scaffold did not have integral prefabricated scaffold access frames.

Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. 29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.
