29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck was dismounted and within 25 feet of the truck still in his view, the load engaging means were not fully lowered, controls neutralized, and the brakes set to prevent movement Emerson Network Power, Energy Systems, North America, Inc., located at 1510 Kansas Avenue, Lorain, OH: On or about March 8, 2012, the employer did not ensure that Mitsubishi (Model FB16KT, Serial # EFB4B00315) forklifts load engaging means were fully lowered when the forklift was parked in the shipping/receiving area of the facility while employees were using it to rewind cable from one reel onto another. Employees were exposed to lacerations, fractures, and broken bones hazards if an employee would walk into the forks of the powered industrial vehicle. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1904.32(b)(2)(i): Total numbers of the columns on OSHA 300 Log did not match total numbers on the Annual Summary: Emerson Network Power, Energy Systems, North America, Inc., located at 1510 Kansas Avenue, Lorain, OH: On or about January 11, 2012, the employer failed to ensure that the total number of days away from work in Column K on OSHA 300 Log for the calendar year 2011 was accurately reflected in Section K on OSHA 300A Log for the calendar year 2011. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
