29 CFR 1926.304(d):  Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:      a)  Worksite, Interior - An employee was using a Makita Circular Saw, #5007F, to cut lumber with the guard wedged in the open position; on or about 3/9/12.    b)  Worksite, Exterior - Employees were using a Makita Circular Saw, #5007N, to cut plywood with the guard wedged in the open position: on or about 3/9/12.        Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.451(g)(1):   Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a)  Worksite, Exterior - Employees were using a Lull Rough Terrain Forklift, #844C-42, to install plywood on a two story residential home.  The employees were standing on plywood placed on the forks approximately 12ft above the ground.  There were no guardrails installed and employees were exposed to falling to the ground below; on or about 03/09/12.    b)  Worksite, Exterior - An Employee was using a Lull Rough Terrain Forklift, #844C-42, to install house wrap on a residential home.  The employee was standing on ploywood that was placed on the forks approximately 12ft above the ground.  There were no guardrails installed and the employee was exposed to falling to the ground below; on or about 03/14/12.      Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

The employee was using lift to install weather proofing house wrap to the exterior of a residential home approximately 12ft above the ground below; on or about 3/14/12.        Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a)  Worksite, Exterior - Employees were not provided with fall protection while installing plywood sheathing to the roof of a residential home.  Employees were exposed to a fall of  approximately 25ft to the ground below; on or about 3/9/12.    b)  Worksite, Interior - Employees were walking and working around a floor opening into the basement.
