29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a) Lot 11, north end of structure at north and west sides of the roof hip; On or about March 8, 2012 and at times prior thereto, four employees installing roofing tiles on a single family residential structure were not utilizing their personal fall protection systems.    b) Lot 12, southwest end of structure at west and south sides of the roof hip; On or about March 8, 2012 and at times prior thereto, three employees installing roofing tiles on a single family residential structure were not utilizing their personal fall protection systems.    Note: Abatement certification is NOT required for this item.

29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head:      a) Lot 11, north end of structure at north and west sides of the roof hip; On or about March 8, 2012 and at times prior thereto, three employees installing roofing tiles were utilizing full body harnesses with the 'D' ring located just above their tool belts.    b) Lot 12, southwest end of structure at west and south sides of the roof hip; On or about March 8, 2012 and at times prior thereto, two employees installing roofing tiles were utilizing full body harnesses with the 'D' ring located just above their tool belts.    Note: Abatement certification is NOT required for this item.
