29 CFR 1926.100(a):  Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a)  On or about March 8, 2012, Fine Construction, as a controlling employer, did not ensure that subcontractor employees working around a scaffold that did not have toeboards were protected from head injuries through the use of hard hats.

29 CFR 1926.451(b)(1):  Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):    a)  On or about March 8, 2012, and at times prior, Fine Construction, as a controlling employer, did not ensure that Extreme Exteriors LLC (subcontractor) protected their employees from fall hazards while they worked from two levels of scaffold that were not fully planked.

29 CFR 1926.451(g)(1):  Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a)   On or about March 8, 2012, Fine Construction, as a controlling employer, did not ensure that Extreme Exteriors LLC employees (subcontractors) were protected from fall hazards of over 10 feet while they walked and worked on upper levels of scaffolding without adequate guardrails or another fall protection system in place.

29 CFR 1926.501(b)(4)(ii):  Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers:      a)  On or about March 8, 2012, employees were exposed to trip and fall hazards because Fine Construction, as a controlling employer, did not ensure that subcontractor employees were protected from stepping into a three and a half  feet deep hole that was located within a couple feet of a building entrance way.
