29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:  Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.    a) Flexible Foam Products, Inc. - Spencerville, Ohio: On or about March 12, 2012, the employer did not assure that employees were protected from fall hazards of approximately 13-feet when accessing the top of truck trailers.  A standard guardrail, or equivalent protection, was not provided to employees that accessed the trailers to conduct repairs.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.1200(g)(1): The employer did not have a material safety data sheet for each hazardous chemical in use:    a) Flexible Foam Products, Inc. - Spencerville, Ohio: On or about March 9, 2012, the employer did not assure employees were provided with a material data sheet for KOI Hydraulic Oil and SAE 5W30 Motor Oil used in the maintenance area, which would warn employees of potential health effects such as, but not limited to eye and skin irritation.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
