29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On February 21, 2012, at a jobsite located at Holmes St and Truman Rd, Kansas City, MO., The competent person had not taken necessary precautions to ensure the safety of employees working in an approx. 7 ft. deep excavation, in that exposed employees had not been removed or protected from the hazardous condition of the excavation. Abatement certification for this violation is not required.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): (a) On February 21, 2012, at a jobsite located at Holmes St and Truman Rd, Kansas City, MO., Employees engaged in gas leak repair activities in an excavation approx. 7 ft. in depth, were not protected from cave-ins by an adequate protective system in the following instances: (1) An employee in the excavation was observed working outside of the protective system, exposing him to serious injuries from potential cave in. (2) The access-egress ladder had been positioned outside of the protective system, exposing employees to serious injuries from potential cave in. Abatement certification for this violation is not required.
