29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.      a)  Employee observed working/walking across the roof and no fall protection of any type was being used to protect the employee who was exposed to falls of approximently twenty-five (25) feet to the blacktop surface below.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:        a)  Employee observed working from the forks of a Lull, Model 644, Highlander II Forklift from a make shift platform (grape basket) attached to the forks of the lift and no fall protection was being used to protect the employee from falls of approximately 25 feet to the blacktop driveway below.
