29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected arouund such holes, At the site, on the roof of the structure, on or about March 12, 2012, employees were installing air conditioning drops (supply and return ducts) next to an approximate 51" by 81" roof opening without fall protection. This condition exposed workers to fall hazards at approximate 22' to 26'.

29 CFR 1926.503(b)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. At the site, while installing drops (supply and return ducts) for air conditioning, employees were working on the roof next to an approximate 51" to 81" roof opening without fall protection. The employer did not maintain training records of each employee, exposing employees to fall hazards in excess of 22'

29 CFR 1904.39(a): Basic requirement. Within eight (8) hours after the death of any employee from a work-related incident or the in-patient hospitalization of three or more employees as a result of a work-related incident, you must orally report the fatality/multiple hospitalization by telephone or in person to the Area Office of the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor, that is nearest to the site of the incident. You may also use the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742). The employer failed to notify OSHA of an approximate 9:00 AM accident occuring on March 12, 2012, resulting in the death of an employee. This fatality was reported to the OSHA Hotline by the Harris County Medical Examiner's Office at 10:48 PM on March 12, 2012.
