29 CFR 1926.652(g)(2): Excavations of earth material to a level greater than 2 feet (.61m) below the bottom of a shield was permitted: a) Employer permitted its employees to enter the trench and perform work when the earth material was excavated approximately 4 feet below the bottom of the support system. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): a) Employees were not protected from the hazard of cave-in while working in a trench measuring approximately 7.6 feet in depth. Cerniglia Co., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA violation number 312596653, citation 1, item 1a, issued on August 24, 2009 and became final order on or about September 23, 2009 with respect to a workplace located at 1150 S. Austin Blvd., Oak Park, IL 60304. No abatement certification or documentation is required for this item.
