29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portableladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps,walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall beused. Crossbraces shall not be used as a means of access.    a.  On or about March 15, 2012 - at the above addressed jobsite, an employee conducting fascia removal operations from a ladder jack scaffold twenty three (23') feet above the ground was not provided with a proper access ladder to the scaffold platform, thereby exposing employee to the hazards associated with falls.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, orladder jack scaffold shall be protected by a personal fall arrest system;    a.  On or about March 15, 2012 - at the above addressed jobsite, an employee performing fascia removal from a ladder jack scaffold twenty three (23') feet above the ground was not protected by the use of a personal fall arrest system, thereby exposing the employee to fall hazards.
