29 CFR 1926.51(f)(1):  The employer did not provide adequate washing facilities for employees engaged in the application of paints, coating, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees. Such facilities shall be in near proximity to the worksite and shall be so equipped as to enable employees to remove such substances:      a) Orpheum Building, 50 Baldwin Ave, Jersey City, NJ    Employees demolishing interior building structures including cinderblock walls and cleaned / swept areas with peeling lead paint, were not provided facilities to wash their hands and face to remove silica dust and lead contamination. A wipe sample indicated the presence of approximately 1128 ug/ft2 of lead on the 3rd floor where employees performed this demolition, and a bulk sample of demolished material indicated 10% silica.       Violation occurred on or about 4-2-12.

29 CFR 1904.4(a):  Each employer required by this part to keep records of fatalities, injuries, and illnesses did not record each fatality, injury and illness that was work related, a new case, and meets one or more of the general recording criteria:      Located at D&B Partners, LLC demolition operations at 50 Baldwin Ave., Jersey City, NJ: The employer did not record the following workplace injuries and illnesses on the OSHA 300 Log for Calendar year 2012:    a) The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent.    i.  On or about April 18, 2012, an employee of D & B Partners, LLC suffered a hand injury from a demolition debris container cover that fell onto the employees' hand.  This employee was prescribed medication for the injury by a physician at Jersey City Medical Center.      ii. On or about June 15, 2012, an employee of D & B Partners, LLC suffered a hand injury from a Makita Grinder. The physician at Jersey City Medical Center signed a document that said the employee is exempted from work for 2 days.
