29 CFR 1910.147(c)(4)(ii)[B]:  The energy control procedures did not clearly and specifically outline the steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy.    (a)Kelley Bean Company at 28810 County Road S., Brush, CO 80723:  The employer did not ensure that the energy control procedures for the bean cleaning, washing and bagging equipment clearly and specifically outlined the steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy.  This condition exposed the employees to an uncontrolled energy source hazard.

29 CFR 1910.147(c)(6)(i): The employer did not conduct an annual or more frequent inspection of the energy control procedure to ensure that the procedure and requirements of this standard were followed:     (a)Kelley Bean Company at 28810 County Road S., Brush, CO 80723:  The employer had not conducted an annual or more frequent inspection of the lockout/tagout procedures to ensure that the procedure and the requirements of the energy control program were being followed to protect employees from unexpected energizing, start up or release of stored energy.  This condition includes but is not limited to grain handling equipment such as bean cleaning, washing, and bagging equipment.      Abatement Note:  The procedures and requirements of the periodic inspection of the energy control procedure shall include at a minimum:      (1)The periodic inspection shall be performed by an authorized employee other than the one(s) utilizing the energy control procedure being inspected.      (2)The periodic inspection shall be conducted to correct any deviations or inadequacies identified.      (3)Where lockout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected.      (4)Where tagout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized and affected employee, of that employee's responsibilities under the energy control procedure being inspected, and the elements set forth in paragraph (c)(7)(ii) of this section.      (5)The employer shall certify that the periodic inspections have been performed. The certification shall identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection.

29 CFR 1910.272(h)(1):  Each employee who walked or stood on or in stored grain, where the depth of the grain posed an engulfment hazard, was not equipped with a lifeline or alternative means which the employer demonstrated would prevent the employee from sinking further than waist-deep into the grain:    (a)Kelley Bean Company, Inc. at 28810 County Road S, Brush, CO 80723:  On March 15, 2012 two employees were directed to walk on a pile of beans approximately 20 feet high in a flat storage structure to remove crusted and molded beans without a lifeline or alternative means which would prevent the employee from sinking further than waist-deep into the beans.  This condition exposed the employees to an engulfment hazard.

29 CFR 1910.272(h)(2)(i):  Whenever an employee walked or stood on or in stored grain or grain products of a depth which poses an engulfment hazard, all equipment which presented a danger to that employee (such as an auger or other grain transport equipment) was not deenergized, and was not disconnected, locked-out and tagged, blocked-off, or otherwise prevented from operating by other equally effective means or methods:    (a)Kelley Bean Company, Inc., 28810 County Road S, Brush, CO 80723:  The employer did not ensure the conveyor in the tunnel under the flat storage structure was deenergized by lockout or other effective means prior to directing employees to walk on the bean pile.  This condition exposed the employees to an engulfment hazard resulting in the actual engulfment and death of an employee.
