29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:         a.  Establishment - As of 03/08/12 a copy of the written hazard communication program was not present at the workplace and available to employees.  Employees used chemicals, such as but not limited to, MMA (methyl methacrylate) Liquid, thinner, and acetone.         b.  Establishment - As of 03/08/12 the written program did not require hazard warnings on containers used at individual workstations. Only the identity was required on these containers. Employees were referred to the material safety data sheets for hazard information.

Establishment - As of 03/08/12 chemicals such as but not limited to, Acrylic Monomer 300 Series V, Thinner, and No Burn Acrylic Nail Primer, were not listed with the identity referenced on the material safety data sheets.         b.  Establishment - As of 03/08/12 chemicals such as but not limited to, GiGi Sure Clean, GiGi Wax Off, Acrylic Powder ND3000, Solar White, and Kelly Polish Thinner, were not included in the list of chemicals.

29 CFR 1910.1200(h): Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(1) and (h)(2) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced:         a.  Establishment - As of 03/08/12, employees were not provided adequate chemical hazard training, in that, workers were not informed of the speicific chazards of the chemicals that were used in the work place. Cheimcals used in the workplace were, such as, MMA (methyl methacrylate) Liquid, thinner, and acetone.    Note:  Effective training includes specific information on the hazards, and where more information can be found. It must also be presented in a manner so that the employee can understand the information. Asking employees to review written materials is generally not adequate.  Some employees may have limited reading ability. Terminology in the material safety data sheets may not be understandable to most. It may be necessary to conduct training in more than one language. To assure understanding there should be opportunity for employees to discuss the material with a knowledgeable person.
