29 CFR 1910.95(g)(1):  The employer did not establish and maintain an audiometric testing program by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:    1) On April 12, 2012, and at prior times, employees were exposed to noise at levels that exceeded the 85 decibel action level and the employer had not established an audiometric testing program.  Employees were exposed to noise above the action level in the following instances:    a) An employee operating the manual mold maker was exposed to noise at a level of 93.51 dBA as an 8 hour time weighted average.  Sampling was conducted for a period of 388 minutes, and the sample included a zero calculation for the unsampled portion of the shift.    b) An employee operating a bandsaw and a dremel was exposed to noise at a level of 90.87 dBA.  Sampling was conducted for a period of 245 minutes, and the calculation included a zero increment for the unsampled portion of the shift.      Note: Two employees operating grinders were exposed to noise at levels above 85 dBA, but below the standard margin of error.  The two 8 hour time weighted average exposures were 86.89 dBA and 86.11 dBA, respectively.
