29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face: a) On or about October 19, 2011 and at times prior, Earth Concept Innovations did not ensure that employees were protected from loose rocks on an excavation face. The employee, working in the blue shale area being excavated for a grease trap and a sewer line, was exposed to loose chunks of shale rock. The shale broke into chunks as it was being excavated.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) On or about October 19, 2011 and at times prior, Earth Concept Innovations did not ensure that employees were protected from cave-in hazards. Employees working in the excavation, near the entrance to the jobsite, were exposed to vertical walls over six feet in depth.
