5(a)(1) Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer furnish employment and place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: On or about March 6, 2012, at the job site an employee was observed climbing and standing on the guardrails of a scissor lift, approximately 22 feet high. This exposed the employee to the hazard of falling.
